Step one: look at how the title is worded
Find the title if you can (and if you can't, a lost title is fixable). The names on it decide the path:
- Both names joined by "or" โ you already have full rights. You can sell the vehicle on your own signature, today, nothing else required.
- Both names joined by "and" โ a transfer step is needed to remove your spouse's name, typically using the death certificate.
- Only your spouse's name โ Florida provides a simplified path for surviving spouses that, in many cases, avoids probate entirely.
What you'll typically need
- The certificate of title (or a duplicate)
- A certified copy of the death certificate โ order several when you're at it; banks and insurers will want their own
- Your driver's license or state ID

You usually don't need to retitle before selling
