Selling a Car After the Death of a Spouse in Florida

First, there is no deadline pressing on you. The car can sit in the garage while you handle everything else — or handle nothing at all for a while. When you're ready, here is how it works, in plain English.

Step one: look at how the title is worded

Find the title if you can (and if you can't, a lost title is fixable). The names on it decide the path:

• Both names joined by "or" — you already have full rights. You can sell the vehicle on your own signature, today, nothing else required.
• Both names joined by "and" — a transfer step is needed to remove your spouse's name, typically using the death certificate.
• Only your spouse's name — Florida provides a simplified path for surviving spouses that, in many cases, avoids probate entirely.

What you'll typically need

• The certificate of title (or a duplicate)
• A certified copy of the death certificate — order several when you're at it; banks and insurers will want their own
• Your driver's license or state ID

You usually don't need to retitle before selling

Here's the part that saves a trip: when you sell to a licensed dealer, the surviving-spouse transfer and the sale can usually be processed together. You sign at your kitchen table once; we handle the state paperwork from there. You never stand in line at the tax collector's office.
