How to Sell a Car From an Estate in Florida

A plain-English guide for executors, personal representatives and family members

When a loved one passes, the vehicle is usually the asset nobody quite knows what to do with. It sits in the garage or carport, the insurance and registration keep coming due, and every path forward seems to involve a form nobody has heard of. We help Sun City Center and Kings Point families through this every week โ€” here is how it actually works.

First question: how is the vehicle titled?

Everything flows from the name (or names) on the Florida title. If the title lists two owners joined by the word "or" โ€” for example, "John Smith OR Mary Smith" โ€” the surviving owner can generally sign and sell on their own. If the names are joined by "and," or the vehicle was titled only in the name of the person who passed, the sale usually goes through the estate.

If the estate is in probate

The court appoints a personal representative and issues letters of administration. Once you have those, you can sell the vehicle โ€” the letters are what give you signing authority. We coordinate directly with the estate's attorney so nothing stalls, and you receive a written offer, bill of sale, odometer disclosure and payment record: a clean file showing the estate got a documented, market-based price.

If there's no probate

Florida has simplified paths for smaller estates and for surviving spouses, and in some cases a vehicle can transfer to heirs without a full probate. Which path applies depends on the estate's specifics โ€” this is exactly the kind of question we'll help you sort out in plain English on the first phone call, and confirm with your attorney where needed.

Helping from out of state? Half our calls come from adult children and executors coordinating from another state. Everything can be handled by phone and email, with you on the line for every step and documents shipped for signature where required.

What you'll want to gather

The title (if you can find it โ€” a missing title is fixable), the death certificate, letters of administration if probate is open, and the keys. That's typically it. If there's still a loan on the vehicle, we contact the lender, confirm the payoff in writing, pay them directly and pay the estate the difference.

What the vehicle is worth

We price from the same live wholesale market data dealers use nationwide, adjusted for condition and mileage โ€” and we show you the basis for the number. Garage-kept, low-mileage vehicles, which describe many cars in this community, are often worth more than families expect. Every offer is in writing and good for 7 days, so you can share it with the attorney, the heirs, or anyone else before deciding.

One call and we take it from here.
We come to the home, handle every piece of the title and DMV paperwork, and payment is documented for the estate file.
